CROWN COUNSEL
The Legal Services Branch for the Ministry of Northern Development, Mines, Natural Resources and Forestry (Northern Development and Mines) has an exciting opportunity for one legal counsel. This position offers challenging work in a small and collegial branch. The main focus of the work will be in providing legal support and advice in the aboriginal law, commercial law and mining law contexts including providing legal advice with respect to the proposed “Ring of Fire” development.
What can I expect to do in this role?
Duties will include:
• Providing written and oral legal advice to clients on infrastructure and mineral and development issues and Aboriginal and treaty rights including the requirements for consultation
• Providing legal support for issues management, communication products and for the development of Ministry policies and operational approaches
• Participating directly in consultation and negotiations sessions with indigenous communities, mining companies and their respective counsel
• Providing litigation support
• Providing corporate/commercial legal advice
• Supporting government-wide Indigenous policy initiatives
• Drafting, reviewing and negotiating contracts and other agreements including transfer payment agreements and memoranda of understanding
• Briefing senior government officials, Ministry management and stakeholders
• Working with counsel, senior management and staff across ministries
• Providing legal advice to support in policy development work
• Leading and participating in committee work
• Serving on, and providing legal advice, to Ministry committees and taking on special projects as needed
• Drafting correspondence and legal documents
• Travel to the northern regions will be required
How do I qualify?
Mandatory
• Membership in good standing as a lawyer with the Law Society of Ontario
Knowledge and Skills
• In-depth knowledge of mining law, in particular the Mining Act (Ontario) and its regulations, aboriginal law and the duty to consult, commercial law, administrative, constitutional and public law
• Demonstrated experience in negotiating with Indigenous communities and mining and resource companies
• Demonstrated ability and judgment to help manage complex and contentious issues
• Experience in legal research and opinion writing, statutory interpretation and policy development work
• Knowledge of mining and resource industries
• Knowledge of environmental assessment and impact assessment processes
• Demonstrated analytical skills and judgment to recognize and assess legal implications of Ministry and government initiatives
• Highly developed policy and political acuity
• Demonstrated written and oral communication skills
• Ability to work effectively in a diverse and inclusive team environment
• Organizational skills and the ability to handle a high volume of work on short notice and with minimal supervision
• Proven ability to work under pressure
• Proven ability to conduct legal research
• Computer literacy
• Ability and willingness to travel
• Demonstrated ability to provide excellent client service and to build and sustain positive relationships with clients and colleagues
